Purchase Terms Agreement
Professional installation required
I understand that many of the products sold by The Torch Guys, including fireplaces, gas-burning fire pits, gas log sets, and related gas products, must be installed, connected, and serviced only by a properly licensed and qualified professional (such as a licensed gas fitter, plumber, HVAC contractor, or fireplace installer) in accordance with all applicable local codes, regulations, and manufacturer instructions. I agree that I will not attempt to install, modify, or service these products myself unless I am appropriately licensed and qualified to do so.
Gas type selection and order accuracy
I understand that some products require selecting the correct gas type (Natural Gas or Propane) at the time of order and that the product I receive will be configured based on my selection. I confirm that I have carefully reviewed my order, including the selected gas type, sizes, finishes, options, and accessories, and that all details are correct for my intended use and installation.
Warranty and compliance
I acknowledge that failure to use an authorized or qualified installer, or failure to comply with manufacturer instructions and applicable codes, may void the manufacturer’s warranty and limit or eliminate any support that would otherwise be available. I understand that the seller does not provide installation services and that any warranty claims may be subject to the manufacturer's terms and proof of proper installation.
No liability for improper installation or misuse
I understand and agree that the seller is not responsible or liable for any damage, injury, loss, or death arising from improper installation, modification, misuse, or failure to follow applicable codes and manufacturer instructions. I assume all risks associated with installation, use, and operation of the products and agree to hold the seller harmless from any claims or damages arising from improper installation or misuse.
No returns or chargebacks for customer error
I understand that incorrect gas type selection, incompatible product selection, or ordering the wrong size or configuration is considered a customer ordering error. I agree that such errors do not constitute a defect or misrepresentation by the seller and do not provide a valid basis for a chargeback. I agree not to file a credit card chargeback based on my own ordering mistakes, failure to read product descriptions, or failure to consult a qualified installer before purchase.
